§ 10-48. Restrictions; food court area of Cherryvale Mall.

  • (a)

    A retailer liquor dealer's license shall permit the sale of alcoholic liquor only on the premises described in the application and license. For the purpose of this section and this section only, the term "premises" shall be defined as that portion leased by the applicant excluding any common area used with other food/beverage establishments, including, however, any contiguous areas in the area of the property to be described in the license which is enclosed and segregated from the common eating area (food court area/Cherryvale Mall).

    (b)

    The holder of any license shall be required to post signage at the entrance and exit of the premises prohibiting individuals from removing alcoholic liquor from the designated premises as stated in subsection (a) of this section. Such signage shall be a minimum of 18 inches in width by 18 inches in height.

    (c)

    Prior to the issuance of any license under this article, the proper mall authorities must execute a consent and deliver the consent to the village authorities which would allow for the posting of the signage referred to in subsection (b) of this section, and the segregation and enclosure of designated areas for the consumption of alcoholic liquor.
