§ 70-92. Notices.

  • (a)

    Initial notice of violation.

    (1)

    The issuer of a parking or standing violation notice shall specify on the notice his/her star number, the particular parking or standing ordinance violated and the place, date, time and nature of the alleged violation and shall certify the correctness of the specified information by signing the violation notice.

    (2)

    The violation notice shall also state that payment of the indicated fine(s), and of any applicable penalties for late payment, shall operate as a final disposition of the violation.

    (3)

    Information containing the availability of a hearing in which the violation may be contested on its merits shall also be contained in the notice, along with the specific manner in which a hearing may be had.

    (b)

    Second notice of violation.

    (1)

    A second notice of violation shall specify the particular parking or standing ordinance violated, the make and state registration number of the cited vehicle, and the location, date, time and nature of the alleged violation, the fine and any penalty assessed for late payment.

    (2)

    The notice shall also state that failure either to pay the indicated fine(s) and any applicable penalties, or to appear at a hearing on the merits in the time and manner specified, will result in a final determination of violation liability for the cited violation in the amount of the fine and penalties indicated, and that, upon the occurrence of a final determination of violation liability for the failure, and the exhaustion of, or failure to exhaust, available administrative or judicial procedures for review, any unpaid fine or penalty will constitute a debt due and owing the village.

    (3)

    Information containing the availability of a hearing in which the violation may be contested on its merits shall also be contained in the notice, along with the specific time and manner in which a hearing may be had.

    (c)

    Notice of final determination.

    (1)

    A notice of final determination shall be sent following a final determination of parking or standing violation liability or the conclusion of judicial review procedures taken under this section.

    (2)

    This notice shall also state that the unpaid fine or penalty is a debt due and owing the village. Failure to pay any fine or penalty due and owing within the time specified herein may result in the village's filing of a complaint in the circuit court to have the unpaid fine or penalty rendered a judgment. Failure to pay may also result in suspension of the person's driver's license for failure to pay fines or penalties for ten or more parking violations under 625 ILCS 56/6-306.5 of the Illinois Vehicle Code, as amended.
