§ 62-207. Environmental report; land/park dedication.

  • Prior to the village's acceptance of land, pursuant to section 62-202, the developer shall perform the following:

    (1)

    After the village and the developer have agreed on the real estate to be dedicated and prior to the village's acceptance of the proposed land dedication, the developer, at their expense, shall obtain a phase I environmental audit and provide a copy of the audit's findings to the village.

    (2)

    If the phase I environmental audit findings state that the property is environmentally contaminated, or that it is inconclusive, or that it recommends a phase II environmental audit in order to be more conclusive, then the village and the owner/developer agree that the real estate will not be dedicated to the village in satisfaction of the owner/developer's responsibility under this article.

    (3)

    Should the provisions of subsection (a)(2) of this section become applicable, the owner/developer agrees to either donate other real estate in satisfaction of this article or to pay the impact fee as dictated by ordinance.
