§ 54-88. Garbage refuse container enclosure.

  • (a)

    Any property owner, tenant, or occupant of property zoned R3, R4, CN, CC, CG, OF, IL, IG or IH shall be required to enclose their garbage refuse containers so that such containers are not visible to the naked eye. The enclosure shall be of a material which does not allow an individual to see the refuse container. The refuse container shall rest upon a concrete pad four inches in thickness reinforced with wire mesh or six inches in thickness of normal concrete.

    (b)

    The village administrator may grant a variance to the restrictions set forth in subsection (a) of this section in any commercial district, provided that it is determined by the village's administrator that the applicant's request for a variance is because of one of the following concerns:

    (1)

    The physical location of the garbage refuse container renders impractical to construct the type of enclosure required by this section.

    (2)

    The cost of compliance with subsection (a) of this section exceeds the reasonable alternative in cost to the applicant in excess of $1,000.00.
