§ 42-96. Junk cars.

  • (a)

    Any motor vehicle or part thereof which is inoperable or deteriorated and is located for 30 days or more upon private property in the village, outside of any enclosure which encloses the vehicle completely from lateral view on all sides and constitutes a danger to persons, including children, or constitutes a blight upon the property or neighborhood in which it is located is hereby declared to be a nuisance.

    (b)

    Any owner or lessee or any other person in control of the premises and the owner or lessee or any other person in control of the vehicle who permits the nuisance described in this section to exist or who maintains such nuisance shall be fined, as provided by section 1-8 of this Code. Each day the nuisance is permitted or maintained shall constitute a separate offense. Each motor vehicle which is permitted to exist as a nuisance shall constitute the subject of a separate offense.
